THE WORLD’S GREATEST NEWSPAPER brings the news that the McCanns’ legal action is against the Portuguese publication Tal & Qual. (The Express, of course, has dutifully repeated all the allegations and smears that have emanated from the Portuguese press, for the delectation and disgust of Maddywatchers back home.) Spokeswoman Justine McGuinness says the McCanns “are not going to be a doormat any more”.
Meanwhile, the paper says the hunt has switched to a campsite in the Loire valley after sightings by holidaymakers.

Moderation, The regent ward of the town is the 3rd most deprived ward in the uk! It has held that spot for 3-4 years now, despite massive funding and an ongoing regeneration program. I attended several brain storm sessions and seminars a few years ago concerned with the rejuvenation of the area.
So you frequent Great Yarmouth the area where a young boy went missing, you are a frequent visitor to the location maddie went missing. Is therre anything else you would like to tell us?

I have family there thank you very much!! It a holiday resort area on the coast with the usual mix of good and bad that occurs in most towns. I go there around 5 times a year!

It did occur to me back in the day when one eyed Murat was made the chief suspect and public enemy number one, for playing the part of the good samaritan, that he may have been put in such a position on purpose. Possibly to allow the mccanns to show their true colours.
But as I said then, The whole abduction theory is just theory and supposition. The apartment was declared a crime scene by the mccanns instantaneously.
Are the Mccanns not guilty of recognizing the apartment as a crime scene and then allowing no less than 20 people into the apartment, which led to vital evidence (defence or prosecution) being destroyed?

I don’t think its fair to castigate the McCanns for doing everything they did. Also I think this case was different because it was on holiday.
Now I KNOW that doesn’t make it any different to losing a child anywhere but it did catch the interest of the press from the first day and you can’t blame them for taking advantage of the interest to raise the profile of the case.
It’s the fault of the press for NOT giving coverage to the other one.
I noticed on one of the forums there was a mention of Rhys Jones the little boy shot dead in Liverpool. Someone said it was awful because he looked like such a nice boy.
Oh right. So its only awful when it happens to ‘nice’ boys then? No it isn’t, its awful when it happens to anyone’s child!! However, the Jones family are quite rightly capitalising on the coverage to try and find their son’s killer.
Its not their fault that the other boys shot dead didn’t get the same coverage.
The Jones family live in a nce house and both work…
And yes the McCanns are working class as it is categorised today. They work. Their families worked. However that should have nothing to do with any of it.

I would assume it is because the press here in the uk are their main promoters of the fund. Should they start attacking the uk press with threats of legal action the tabloids would close ranks and destroy the mccanns. They have enough information on them already to squash them. they are just bidding their time before the backlash.

These folks were normal working class people that ‘lost their son’ in great Yarmouth (the most deprived area in the country) about 6 years ago. there was no invitation from the pope, there was no promise of a reward by Businessmen Sir Richard Branson or Sir Philip Green , there was no support from Wayne Rooney, david beckham, rebecca loos, J K Rawlings to name but a few.
There was no appeals during the F A cup final and there were certainly no interruptions during a childrens film at the cinema.
They never got to speak to the brother of ken bigley and neither did they invade the privacy and grief of the newly murdered youngster, who’s name escapes me right now.
We are told this was all made possible through contacts of friends!
The Entwistle family didn’t have a pot to piss in then, and they don’t have a pot to piss in now!!!!!!

225 -Richard Jewell was cleared of the Atlanta bombings but he had other stuff in his past which was why he was under surveillance by the FBI in the first place. So that’s what I meant when I said, when there’s smoke there is (usually) fire. One door closes and another one opens up. But that’s a moot point as he’s no longer with us as of last Wednesday.
226 - If I tallied up the combination of hours that our UK and British counterparts spend on the Madeleine forum, it far outweighs the # of hours your “obsessive ritualistic diseased” American Cousins spend here. Given the time difference, I think what you are seeing is merely a game of catch up. But who’s counting? Collectively we are all working for the same cause.
I do agree w/ you on one part and a most important point here though, and that is the part about the press. “Newspapers……in NO way can tell downright lies and fabrications”. Although I would have said it much differently - in concept and theory you’re right. The press have an professional OBLIGATION to report the facts to the public and unless they are writing the Editorial Page commentary, they have to stick to the facts without editorializing. True investigative journalism was founded on factual reporting. It’s one of the reasons that newspaper reporters typically start off as “fact checkers” for years before ever given an advancement to a byline. I spent several years doing that for a local newspaper before moving onto copyediting. I no longer work in this field but have family and friends who work at some of the largest metropolitan newspapers over here. I don’t know if you remember the guy that worked for the NY Times a few summers ago? He made up all those stories for years about interviews with famous people that never took place before he was caught. It was an outrageous abuse of the freedom of the press. Write what you want but as a reporter, you need to make sure you’ve got the facts to back it all up. The NY Times was never sued for anything that he fabricated so far. Which is really a miracle.
The thing with going after libel lawsuits is that the monetary reward on an individual is often so small it’s not worth the time and effort to pursue it. On a major newspaper like the NY Times it’s huge. But if every blogger was sued for libel based on blasphemous remarks posted on the millions of websites out there, the court systems would never get through all the complaints. Most of the time they are just dismissed by the courts before they ever reach that level. If there’s no money involved, then the plaintiff spends more going after libel suits than they’d ever stand to make. Should they spend $10,000 in attorney fees going after $500.00? And how many times can they afford to do that? It’s a monetary issue and the amount needed to layout is not worth the R.O.I. since it can take years before going to court. That’s the information I’ve been given from my newspaper sources.

I’m beginning to think that you have some curious malady!! You seem to spend morning, noon and night on this Forum, and are in great danger of catching that obsessive, ritualistic disease so frequently observed in our American cousins who post here! It was inevitable, was it not, given all that we have discussed about the Portuguese press, that I had already stated on SEVERAL occasions that Newspapers, however much they like to moderate, elaborate or exaggerate their stories to make better ‘copy’, in NO way can tell downright lies and fabrications. I have also previously stated that I was surprised that ‘Team McCann’ had hitherto NOT instigated proceedings against the press for Defamation. I am, however, surprised that they have pursued the tacky little rag, ‘Tal & Qual’, when the allegations have been aired on at LEAST half a dozen Television Broadcasts. More saliently, the BRITISH press have repeated a lot of what has been stated in Portugal, and although they may have added to their copy the statement that the McCanns deny the allegations, or more usually, are ‘hurt/outragedf/disgusted/amazed/fuming etc…’ printing such such epithets does NOT render them immune from the same Libel laws that Gerry & Kate are now exploring with ‘Tal & Qual’. Rather strange course of action, methinks………

Julie, I don’t beleive the PJ found anything meaningful on RM’s computer or in house etc. Its note clear which ‘facts’ ahve stood the test of time. The phone calls to Malinka, maybe. In any event, there might be reasons why the PJ wanted RM on the street.
Picking up on the IP address discussion. IP addresses are the endpoints of network traffic. Think of them as telephone numbers. There is lots of routing of data packets going on (bit like voice and telephone exchanges). Usually, when you connect to the internet via an ISP you are assigned an IP address by them. That assignment will be logged. Anoraks’s server will log your IP address when you make posts. In short you are tracable via your IP address, so you should exercise reasonable care over what you say. In practice, the server for this site is US hosted. A warrant in the US would be required to access the IP address log of posters, then warrants for each ISP etc, so the process would be non trivial and would only be undertaken if there was serious cause to do so. I’m sure Mods & Admin can comment further if they so choose on this, but the warning stands.

Afraid I have to go with Moderation on this one. If the PJ did find child porn on his PC, there is just no ways that he would be walking around the streets today. Not once has he even been put behind bars since he was brought out into the limelight. This only tells me one thing : NO child porn was found on his PC.
The thing that first made me post on Anorak (a while ago) was that there were a couple of posters who were screeching “Paedophile”. I politely tried to warn them that by doing so, they were leaving themselves open to all sorts of civil claims, in particular because there was nothing to prove that he could be branded a paedophile. Oh yes, they were chanting back at me … he had child porn on his PC …. huh? Emphatically denied by the PJ!!! Well ….. I just left them at it.

Tessa, (post 155)…it is morning in the states and I just read your post. You are extremely thoughtful…(have you read the book “The Tipping Point”…it talks about different styles in coming to the same conclusion, et. al. analysis v intuition)
When this tragedy first occurred, I, as most others, just thought poor child has been abducted. I no longer feel this is the case. Nothing adds up. I think you are also correct in your analysis, that they do not have easy minds or consciences. Time will tell.
Re: Richard Jewell was totally cleared. They arrested a fugitive who was hiding in the wilderness for months who had committed other crimes including the bombing (Eric Rudolph)..quite infamous…he murdered abortion doctor, etc. real nutter…

204 Murat isn’t allowed to respond to anything at all however his lawyer stated categorically that there was no child porn etc. The PJ agreed to that statement way back.
I know the differences in porn… I worked in child protection for many years until fairly recently. Striaghtforward adult porn is not illegal, downloaded or not but any downloaded child porn is. Trust me, Murat would have been locked up in May as would Malinka!!
It would really be a good idea to go back thru archives and check all this out.
It would be libellous to state that ‘Murat had child porn on his PC’ as a fact.
I don’t really mind if you all want to land yourselves in bother, I was just pointing out what the situation was!! its happened before and can easily happen again. Hence Anorak’s disclaimer!!

I would guess that email monitoring has been done via a remote keylogger or something similar … these programs are easily installed via email, without the user or any firewall detecting them and will enable a remote ‘monitor’ to see a screenshot of every single thing looked at on their computer after the program was installed.
If that is the case, then it would not make sense for the police, either PJ or British to inspect hard drives until absolutely necessary - to do so would only serve to make people wary of using their computers.

Itsme - I agree with you - the wording of Gerry’s statement is extremely odd… I would have expected a definitive statement that the T&Q article was speculative and innacurate, not that ‘we firmly believe’.
Plus, as you say - the article mentioned sources, it did not quote from official sources.
Incidentally, there was some debate over what the name of T&Q translated as - I can clear that up … it translates as “As it Appears”.

212 - I read they were haviing their emails monitored but nothing have I heard or read about their hard drives. It’s a good question.
I also don’t know why they’ve not been given lie detectors. Is it because they are not suspects? Probably so….
I remember hearing Mark Klass say so many times when his daughter Polly went missing, that he begged to take a polygraph test because he wanted to clear his name from the begginning. He says this is what every parent should do in the first 48 hours of a missing child case. So that the police can quickly eliminate any family members who may be suspects. It helps facilitate the police investigative work and lets the police focus on the real perpetrators. I wonder if the center for missing and exploited children whom Gerry went to visit on his trip to DC in July had suggested he do this? John Walsh and Mark Klass work closely together on this organization and I’m sure they’d recommned this to the Mccanns could clear their names. It would also help their libel cases if Gerry follows thru on his plans to sue the papers as he stated in yesterday’s blog. I wonder what John Walsh spoke to Gerry about when he made his US visit this summer. He could surely give him a lot of advice and steps to follow to clear his name. It would also benefit his libel suit.

Both TVI and SIC reported the portuguese lawyer will be advising the family McCann. No mention of any Lawsuit.
Said as well that this lawyer will be replacing the British ones that up to now have been advising the family.
