THE WORLD’S GREATEST NEWSPAPER brings the news that the McCanns’ legal action is against the Portuguese publication Tal & Qual. (The Express, of course, has dutifully repeated all the allegations and smears that have emanated from the Portuguese press, for the delectation and disgust of Maddywatchers back home.) Spokeswoman Justine McGuinness says the McCanns “are not going to be a doormat any more”.
Meanwhile, the paper says the hunt has switched to a campsite in the Loire valley after sightings by holidaymakers.

The Telegraph reports that the McCanns say they are suing to clear their name, not for the money.
THE TIMES page 5: Candle of hope for Madeleine
The paper says that Madeleine’s classmates “said a poignant prayer” yesterday, on what should have been her first day at school.
DAILY MAIL page 6: McCanns to sue over ‘killers’ slur
The paper says the McCanns believe it is time to stand firm against the allegations.
DAILY MIRROR page 11: Maddy school’s prayers
The paper says the McCanns spent a quiet day with their twins in Praia da Luz.
THE STAR page 22: SCHOOL’S SAD WAIT FOR MISSING MADDIES: Chair and locker are saved for her
The empty chair, locker and coat peg are once again invoked. Bishop Ellis headteacher Gail Neill says: “We are deeply saddened that we cannot yet welcome Madeleine McCann.”
THE SUN page 12: MADDIE SCHOOL PRAYER TRIBUTE
The paper also reports on the candle that is being kept burning at the school.

Martin, I haven’t got a clue what evidence they have against Murat. Guess they’re a law unto themselves?!
That’s why all this extradition talk is a joke. If the PJ thought the McCanns were involved they would have done something by now. They are not slow and careful as Murat can confirm! And of course the PJ (Sousa especially) constantly reiterate that they do not suspect the mcCanns of anything… and now they say they support the legal action. What more do you want??!!

Id be happy with just some evidence of an abduction at all.
I too have been a little puzzled and bemused at the pj’s requests to the mccanns to remain in Portugal. Surely when there is a breakthrough in the investigation the press would descend on the tapas two like wolves.
I’d wanna be behind my own closed doors and avoiding them personally.
But then again I have not made it my mission in life to be on the front pages of as many newspapers as i can for as long as I can

Irrespective of the word used, would I be right in thinking that, if they were to return to England, they would be automatically “extradited” if the Portuguese authorities so wished? As far as I recall from other cases, what sometimes happens is that the authorities of the country where the person is located may argue that they want to put them on trial for another matter in that country before allowing the extradition.

My Portuguese contacts are reporting that the PJ are refusing to confirm or even comment in respect of the proposed libel suit, or anything at all in respect of media reports.

Then surely Moderation the PJ should sue or arrest the newspaper owner not the McCanns.
I thought the McCanns had no money left so tell me are they going to use the FIND MADELEINE FUND to sue the newspaper with????
Anyone else would demand an apology not sue - would you spend precious money that could help in a search for Madeleine?
I would not!
And is this how they keep themselves out of the tabloids? By putting on a full scale court show?

I agree with Molly on the reasons for suing. I think it’s probably one of the few occasions where a paper has apparently told a downright lie by saying that the PJ have said something that they haven’t.

‘Childsafety’, You’ve got the wrong end of the stick about what they are suing for.
The rag-mag said that the PJ had told them that the McCanns killed their children. The PJ have said they never said that……. that is what its about.
Its about the rag-mag pretending to have information from the police that they then put forward as fact.
Its about lying basically and the PJ support the legal action because they are also being portayed as ‘leaking info’ to this rag-mag. which they deny!
Why is everyone so prepared to believe everything bad that is put out in the downmarket tabloids but any of the good stuff and denials by by PJ?
Extradition. The McCanns are free to come and go as they want in theory but I bet that if did try to go and the PJ didn’t want them to then they would be arguidos before they got to the airport.
They don’t need a lot of evidence for that. Look at Murat!

Lets look at the facts.
The test results are due out in a couple of weeks time.
The police suggest that a breakthrough is coming in acouple of weeks time.
Gerry and Kate are planning on returning home in a couple of weeks time.

All good points childsafety … The ‘paper’ concerned is a complete rag of the worst kind, but if the PJ are really supporting the McCanns in a Libel suit then I would be extremely suprised!
Think about it - in order for the case to suceed the PJ would have to go to the civil court and reveal/confirm that they do not believe that the McCanns killed Madeleine. That alone would necessitate them speaking about the investigation, which they cannot do.

Molly, are you sure? The Spanish term used when they want to try somebody in Spain and have to bring him from Portugal is definitely “extradition”.

Just wondering if they are under some kind of “threat” of being designated as “arguidos” if they do leave. GM’s arguments about not wanting to return to Britain with only 4 members of the family do not really ring true at this stage. They don’t appear to be doing anything that they couldn’t be doing in Britain. In fact, to judge by Gerry’s blog, they don’t seem to be doing anything at all except jogging. It may be understandable that they want to be close to the case but I haven’t noticed them dashing off to be close to any of the supposed Madeleine sightings, which I would have thought came into the same category.
And I would have thought it would be better for the twins to get back into some kind of normal routine.

There would be no need to initiate an extradition order - a European Arrest Warrant would be sufficient between two EU Countries.

I think that the pj would not be able to stop them from traveling back to the UK unless they would to change the status of the Mccanns from Testemunhas (witnesses) to Arguidos (suspects).
To do so I imagine the PJ would need some rock solid evidence that they were / or could be directly involved in committing a crime. It doesn’t look like at this stage the PJ has enough evidence to substantiate such accusation (otherwise I imagine they would have done it already).
When we mentioned extradition, we were talking about the eventuality of the Mccanns returning to Leicester before the PJ gathered enough evidence that could substantiate a change in their status (from witnesses to suspects), and possibly subsequently charging them with a crime.
Anyway - doesn’t really matter. IF they are proved guilty in a court of law, wherever they are (UK or other European country) there’s always the chance of getting them to justice.

How are they going to prove that they didn\’t sedate their child if they are not allowed to talk about the case.
Either they can talk about the case or they cannot!
Why didnt they speak privately to the newspaper bosses telling them why this cannot be true and request that an apology is written.
I think that sueing is more about putting the frighteners on people like us than anything else.
What they most want is for the general public to be on their side and not to question them at all.
When celebrities sue it makes them look worse in the public eye, unless they put the money to charity. Of course, in this case the money will go into supporting the family with the fund they own.
Which of course will be what they will use to sue with…ha ha ha

they wanted to return home and police told them better to stay because of a “breakthrough”…
why should a “breakthrough” stop those people to get back to their normal lifes and home ?
why should that mourning couple being kept from returning home and find comfort and deflection there ?
-> any other reason than avoiding paper-warfare and complications to get them back for arrest ???

They would have to extradite them if they went back to England, though, and they keep saying they are going. It is noticeable that the PJ apparently keep suggesting they shouldn’t go as there is about to be a breakthrough. But, of course, they theoretically have unrestricted movement and, unless they are actually accused of something (or, perhaps, designated as “arguidos”), there would not seem to be a lot that the PJ could do to stop them if it came to the crunch.

Back to extradition… why would Portugal need to extradite the McCanns as they are duh! in Portugal? If the PJ suspect their involvment there is no way they’d let them out in the first place would they?

Dear All,
I am growing increasingly bored with the McCann’s behaviour and their precious egos, they caused the original problem by neglecting their children -all 3 of them.
They & and their friends were then (at best) economical with the truth and gave conflicting / misleading accounts of what happened; which has certainly not helped anyone find Madeleine.
They then launch a high profile media and propaganda campaign which is only allowed to promote them in a good light and does not help the plight of their missing daughter.
I have know idea whether any of the reports being leaked to the press in Portugal are true, but what’s the expression? He who lives by the sword, shall die by the sword.
They will get exactly what they deserve from the Portuguese media and that is precisely nothing, be that money or respect, because they have brought it all upon themselves.
I have mourned for their poor daughter but am sick with the sight of them.

I believe Pepe is right and that they would have to be extradited to face charges in Portugal. But I also imagine that, if it were actually proven that they had anything to do with M’s disappearance -particularly if they inadvertently killed her- the extradition would be allowed. I imagine that, in the previous case mentioned, the Portuguese authorities weren’t interested in extraditing the people involved.
Something to think about, though.
