A “Not proven” verdict would be a very unfair and damaging one. Innocent people could be tarnished for crimes which it was not possible to prove one way way or another.

Portuguese detectives request more time in Madeleine McCann investigation

LISBON, Portugal - Portuguese detectives investigating the disappearance of British girl Madeleine McCann have asked the attorney general to keep documents in the case classified.
Under Portuguese law, the details of investigations are secret for the first eight months after police identify a formal suspect - a deadline that falls next week.
However, police can ask for more time in exceptional cases and official suspects, police and lawyers can be prosecuted if they discuss details of an open case in public while it is classified.

This information is also being released by Lusa, the central newsagency for Portugal.
Although this was widely expected to happen, and is being seen as normal procedure due to the fact that there are pending diligences to be executed in England, it needed ‘official’ confirmation. Anyway, the news is that the formal request has been made. It still has to be formally approved, too. Again, although it is indeed expected to be approved by the instruction judge, it should be reported for what it is, for now: a request.

Under the new Penal Code, the secret of justice will still prevail in the investigation phase, it’s only when charges are pressed (the instructory process) or the case is filed that the evidence must be made public. So if they hadn’t requested this extension they’d have to file charges, if any, right away AND make the evidence public. And anyway, further investigations can be carried out after the charges are made and further charges may be added as a result of those investigations before the case reaches court.

After more than 8 months, one would expect that all forensics would have been done, and all witnesses would have been interviewed and, if necessary, interviewed again. What is missing, nonetheless reasonable, expected to be found?

I went back to work when my first Smuddlet was 6 months old and he was looked after by his aunt who had 3 older children. I used to pick him up after work and to be honest, he didn’t want to come home with me! He would rather have stayed in a house where he thought of himself as the youngest of 4 children and was loved, entertained and pampered by his cousins, than come home and be the only child with merely 2 doting parents as his captive audience!
My point is that even though he was only 18 months old, Smuddlet #1 knew he wanted to stay with his 3 older cousins and bawled accordingly at pick-up time; 18-month olds will act upset if they feel upset. If the McCann twins didn’t act upset when their parents were leaving them for Rome, maybe they weren’t upset because their parents always left them. Just an observation.
BTW, when I had Smuddlet #2, I gave up work altogether because I wanted my children to know that I was their mother, no-one else, and that our family was made up of Ma, Pa, Smuddlet 1 and Smuddlet 2, with loving cousins and aunts in their own family units.
I must point out that I found being at home with my kids so much harder than my paid job that today I would rather crawl over broken glass than go through those full-time-mum years again but I know that the relationship I have now with my two teenagers is as strong and loving as it is today because I made that decision. (Oh, and I never left them alone in the house while I bogged off down to the Tapas Bar)
