The paper says he looks not too unlike the man seen walking from the holiday complex holding a child. You know, that man with no face…

I am the victim of a smear campaign by someone with a grudge against me… During the week two detectives had arrived in town and begun asking friends about my whereabouts. I rang them after they left a message with a friend. I met them in a car park in Praia da Luz… They were two detectives from the Lisbon area, a good cop and a bad cop. One guy was quite small and smoked a cigar. The other guy was really fat, wore girly sunglasses and kept looking around him all the time”
A good cop? We know all about the bad cops (see the Sun). But this good cop..?
They showed him the email. It went:
“Is it a coincidence that this man started working as a gardener in the area and a child went missing?
“Maybe he walked through the car park at the front of the McCanns’ apartment and a little way down the dark alley between the two buildings where he could see and probably hear that the McCanns were there.
“After that maybe he listened at the window of the McCanns’ apartment for any sign that someone such as a babysitter was there. No television…nothing.
“Did this man initially see the McCanns and Madeleine whilst working on an empty apartment/villa and note that the children were left alone? Did he then come back to watch the McCanns when it was dark and not during daylight hours?”

130 Daisy (sorry, typo on your name before). What was the motive for kidnapping? Most kidnaps are motivated by money. Whilst the McCanns outwardly appeared ‘well to do’, the MW resort is hardly a millionaires’ hang out, and their finances seemed to be pretty stretched.

Which would fly, except for a key ‘fact’ - the only ‘fact’ available to us which supports any kind of proof of abdcution - Tanners sighting of the cartoon man.
He could not have passed Gerry, Tanner and Jez and got to the point of sighting by Tanner - actually that whole sighting would be exposed as a ludicrous invention if the man had left by the patio doors.
Any theory of exit by that route wipes out the only abduction ‘evidence’.

Incorrect. Evidence is legal fact. Proof is the legal version of truth. Im not discussing legla cases here - judges too have different perceptions, or there wouldnt be any appeal courts or court heirarchies or precedent or statutory interpretation or disgareemtn on what the facts are!
I would never be ‘laughed out of court’ because we are discussing facts which would not be recognised by a court and such a debate would never take place in a court - we arent in a court!
I repeat, your percetions are different to my perceptions. Your facts are different to my facts.
Millions of people believe different things to factual. If you cannot see that by disagreeing with me you are proving my point, then I dont think further discussion on the subject betwene us will be fruitful to either of us!

The problem with your view is that the claim that ‘Evidence is legal fact’ is not only wrong in law but self evidently must be a question of law.
I can prove that.
You cannot prove the opposite.

Oh and one other thing, its difficult to cite cases where evidence (facts) were inadmissable or suppressed!
Thats my point. The facts presented may not be all of the facts (and rarely if ever are all the facts).
From those ‘facts’ presented the court will apply the law. It will not apply the law to ‘facts’ not presented. The perception is that no other ‘facts’ exist, as you cannot compare any ‘facts’ to the law if you dont have those ‘facts’ to present.
So the existence of fact, the presentaion of fact and the definition of fact all impact on the outcome.

114 Ferdinand - in Italy, and not sure if it is the same as in Portugal, but the first thing that the police do when there is a kidnapping, is to freeze the bank accounts of the family to stop them paying a ransom demand to kidnappers. Italians do not negotiate with kidnappers, (allegedly).
Considering that the McCanns were unable to pay their mortgate shortly after the ‘abduction’, I seriously doubt that Madeleine was a kidnap target for financial gain.

Well, my theory actually is that they could have entered and existed through the sliding doors, after Gerry had made that check (if he indeed checked on the children as he says). They could have been hiding and waiting for this check to happen and they could have quickly sneeked in, take the child and leave, all through the balcony/terrace. Just a theory.
