It doesn’t have to do anything; if the suggestion is that they were much further away than even the Tapas Bar then obviously the point is relevant to the question of just how severe the neglect might be.
I have long speculated that the alleged substantial delay in calling the police may have involved extremely hasty attempts to get legal advice on their position.
You have to bear in mind that the automatic reaction of a doctor to ‘disaster’ is to call the MDU; I assume that the MDU wouldn’t touch this case with a bargepole, but the Tapas 9 may have been calling other lawyers…

There has been discussion here in the past about a technicality in the Portuguese child neglect laws. I don’t actually know if this is true or not, so please don’t anyone shoot the messenger!
The suggestion is that the Tapas Bar is technically a part of the same complex as Apartment 5A and under Portuguese child neglect laws they would be deemed not to have left the apartment complex and therefore they haven’t broken any laws. Bizarrely it appears, if this is indeed true, that the distance from the apartment to the Tapas Bar has no bearing on whether it was legally neglectful to have allegedly left the children unattended in the apartment.
Now, obviously the matter becomes very different if they were indeed at Chaplins with the children left unattended in apartment 5A.

I have no desire to shoot the messenger; I would simply express scepticism about an unattributed claim that a specific part of Portuguese law could be so easily vitiated.
And that I very much doubt that there is a definition of a ‘complex’ in Portuguese law.
I find it much more plausible that someone who is familiar with Mark Warner’s usual modus operandi assumed that the Ocean Club apartments were part of a gated compound organised and run in the usual way by Mark Warner, and came up with what s/he thought would be a spiffingly good legal argument.
People who assume that they know the facts often come up with what they think are wonderful legal arguments…

REPLY: I have stored a large quantity of press reports on the case but they’re not in any kind of order. As you know, not all press reports are put on line and some of those that are put on line disappear. I will keep a look-out, but as you say a Google search reveals only Forum comments like this one:
“I would also like to know if it is true that on the Tuesday evening of their holiday, the McCanns were dining at Chaplin’s restaurant which is around 800m from the apartment. And if they were dining at Chaplin’s that evening, was there a baby sitter? Or were the parents checking, ‘very very regularly’?”

We dont, but neither do we need to make a case, thats the job of those who have the facts - the PJ.
However, I have to point out that we do have many facts.
Fact: Gerry tells us he saw Madeleine alive at 9:10. OK, he never said alive, but we have to assume he had reason to think she was alive or he’d have raised the alarm.
Fact: Tanner tells us she saw a man carrying Madeleine at 9:15.
There are others, but those two are critical.
One other fact, nobody knows 100% that this was a case of stranger abduction, yet the McCanns ask us to accept it as a fact. Fact - the McCanns want us to stop looking at any option except abduction. In fact, they want us to stop looking at how an abduction took place and just search for Madeleine! A desperate and directionless search, perhaps even stop searching and start looking at cross border security arrangements!
So, in my view, there is another vital and arguably inferred fact - the McCanns do not want us to focus on their part of this sorry tale.
I think we should not get hung up on not having too many verifiable facts - as we’d have nothing to discuss.
Tell me this, would it suit you if we stopped discussing anything except abduction?

CM - The ‘movie’ would be more a documentary to highlight Maddies disappearance and to keep her focused in the public eye (or words to that effect) then he goes on to say there will be NO movie until Maddie is found dead or alive!!!!!!!!!!!!!!!!! Um if Maddie is found dead or alive - why a ‘movie’ to keep her focused in the public eye?

It was an incredibly quiet night, dont forget!
The McCanns, their supporters and friends could be left alone for a month or two and they’d provide enough to prove either that there was no abductor or that the T9 were the most dreadful parents in terms of their protective role!
The difficulty they have is they are being pressed to prove abduction, when they dont want to have to prove it - they just want it accepted.
At the same time they have to prove that they were not neglectful, or the impact on career will be significant and they may face charges from that direction. The less neglectful they were, the less likely is a stranger abduction. The mroe neglectful they were, the more likely is the possibility of stranger abduction! They are in a classic cleft stick, stuck between a rock and a hard place.
They need Fiona Phillips and other supporters to make it look as if they are saying they regret leaving the children unattended without really saying any such thing - they need attention off the cause and onto the idea of searching for Madeleine.
Their strategy is and has always been totally transparent to anyone with a clear and keen mind - many such people post here!

There are two versions (at least)! In one Gerry had a protractor and measured angles, in another he thought Mdeleine had gone to the toilet (and hence wasnt there).
Why were Gerry and Kate so sensitive to the question ‘who saw Madeleine last’ - have a watch of the Spanish ‘tears’ interview - when that question is asked, its clear Kate hesitates and Gerry steps in quickly.
