Does he have to speak with the McCanns detectives?

I cannot even drive.’ Altura is close to the Spanish border and detectives from Metodo 3 – the agency working for the McCanns – were last night travelling there from their headquarters in Barcelona”

Have you perchance taken a wee look at the UK’s record before commencing slagging off the Portuguese?
I wonder how far the Portuguese have embraced the United Nations Convention on the Rights of the Child (UNCRCUN)? The UK has a couple of ‘exclusions’ I understand?
Any chance we might concentrate on the rights of children and a little less on the rights of parents?
I think the parents (in this case in particular) have sufficient resources and power, whilst children are generally in need of assistance.

I’ll explain, since you seem to be easily confused.
You can’t be a “little bit pregnant”. Pregnacy, or non-pregnancy is an absolute condition.
Just like Convention Rights are absolute (except where circumscribed in the convention itelf).
Your right to legal remedy, which is what Articles 6 and 13 are about, is not constrained by the degree to which rights are infringed.

I have.
Have you? Looking at the Article 6 cases, and excluding those that are related to the length of Civil proceedings:
In the huge majority of cases, Portugal was found to be in violation (Magro, Commingersol, Castanheira Barros, Garcia Alves, Magalhaes Pereira, Pestana, Czekalla, De Sousa Marinho, Maire, Carvalho Malagaes, Rocha, Alves, etc….), and in a few more, it caved in and settled out of court (SN v Portugal, Coelho Osorio, Silva Bras, Barbosa), the state has settled out of court.
In fact, I can only find two cases where the case suceeded in having the case struck down - both pertaining to civil actions.
And, of course one of those, “Tome Mota” established that there was ajudicial review process within criminal proceedings - but that’s specifically ruled out within the determination of extensions to Judicial Secrecy, so has no relevance here.
So, it seems the portuguese system has a pretty poor track record in front of Strasbourg for Article Six cases - which ones were you thinking of?
