Since my daughter Rosie was a baby, she has always come everywhere with us when we go on holiday, especially to child-friendly countries such as Portugal, Spain and Greece. We wouldn’t have dreamed about leaving her behind to go for a meal because we go away to spend as much time as possible together as a family.

Do you remember when you put your first baby to bed with a listening monitor and sat downstairs watching the box almost with subtitles on so you could hear every heartbeat?
If you heard an unexpected cough or belch you would sprint up the stairs faster than druggy Dwain Chambers on steroids to check on your little angel. That’s called parenting, isn’t it?
I wonder if the McCanns were as casual with their passports and valuables when they went out at night because as far as I am concerned there is nothing more precious than your child and they appear to have had scant regard for their safety.

There is a fascination in a momentary mistake that can never be undone, no matter how much a mother persecutes herself. In Greek tragedy, Antigone, the daughter of King Oedipus, cannot rest until she has recovered the body of her brother after his death in battle and given it a proper burial. One suffering leads to another. And there is some of that obsession, and that remorselessness, in the case of the McCanns.
But:
Do the two doctors really deserve two whole hours of prime-time when so many other people’s kids are lost and thousands are dying in Zimbabwe? Even those, like me, who have never doubted Gerry and Kate’s innocence must feel a flinch of unease.

Only recently I became familiar with the change of the law in the UK (i saw it in another board).
I believe that there may be ways of enacting the same effect of that UK law in Portugal even without changing the existing portuguese penal code. But it’s not as straightforward as the routes I outlined in my previous post (determining time of death or confession).

Aníbal Malvar says that his article in “El Mundo” was misunderstood
The author of the devastating article published in “El Mundo” says there is a misunderstanding… But he apologises
The journalist that wrote an article in “El Mundo” about the PJ inspectors, namely about Gonçalo Amaral, apologises.
“It was never my intention to offend the Portuguese police or Gonçalo Amaral. If I did it, I apologise”. This were the words of Aníbal Malvar to the 24 Horas yesterday.
The journalist, 43 years old, that will be sued for what he wrote said that he tried to speak with Gonçalo Amaral to clarify any misunderstanding but was not able to.
Aníbal Malvar says he is surprised with the repercussion that his article published last Sunday is having in Portugal. “The article is a literary one and has several sarcasms and it’s perhaps because of that that was misunderstood”, he claims.
Malvar says that he made critics but to the British police. “What I wanted to denounce was that the PJ of Portimão could not do their work because the British colleagues did not allowed. The influences were several and at a high level”, he said to 24 Horas.
“Removed by political reasons”
The Spanish journalist says that the former coordinator of Maddie’s case was a person with clear ideas about the disappearance of the little girl”. His conviction was that the McCanns were involved”, assumes the journalist.
Malvar claims that Amaral, with whom he talked once during more than three hours in September, last year, in Algarve “was removed from the police by political reasons”.
In the article it is attributed to Gonçalo Amaral the following sentence about Kate: “You did not see the mother (of Madeleine). You don’t know the mother. She is cold. She is cunning. She is an actress”. Gonçalo Amaral said that he is going to sue.
“Silliness is not a crime”
Paulo Pereira Cristóvão, former PJ inspector, received yesterday a phone call from the journalist of “El Mundo” asking him if two of the policemen of his book “The star of Maddie”, João Tavares e Francisco Meireles, were true or fiction. The Spanish journalist used these names in his article with some sensational sayings. Example “We smoke, we like to eat and to drink”. Cristóvão said to him that they were fictional. “Although he publishes passages of my book I don’t have how to sue him because being silly is not a crime” he said to 24 Horas.

I’ve thought before that the children were very young to have an enforced 7pm bedtime. IM experience they have afternoon naps at that age and can stay up quite late.
This latest account is turning the whole explanation into a farce. Who ever heard of parents of young children not talking a buggy with them on holiday? Why did they need to be asked if theier planned chacks was going to be ok? Of course they can think for themselves and not take calculated risks with child safety, can’t they? Does G not know how silly he sounds? ‘…we weren’t directly there and if we were, then, you know, possibly, probably, it wouldn’t have happened’.
I don’t like to be critical but imo suspects should shut up, and if there are to be any charges speak then. Off now

And this is why the new offence of causing or allowing the death of a child or vulnerable adult was introduced over here.
Perhaps when all the dust has settled the Portuguese legislative body might consider something similar…

ALERT - don’t be led to believe that Jon Gaunt is a foe of the happy band.
Jon Gaunt maintains that Madeleine was abducted. There’s no evidence of that.
Jon Gaunt is being used to indirectly promote the abduction theory and discrediting the investigation. Yes, on the way the Mccanns may get a bit of flask by some viewers calling them irresponsible, but nothing that can’t be fixed with the odd viewer calling in and saying “don’t you think they’ve suffered enough already?”…The end result is… yes the McCanns were a bit irresponsible… but hey who”s perfect? The PJs are a band of bastards.
THIS IS THE PLAN. DON’T THINK JON GAUNT IS THERE TO CHALLENGE THE MCCANNS - HE IS THERE TO STRENGHTEN THE ABDUCTION THEORY AND DISCREDIT THE INVESTIGATION.

Thanks to you all for your views on the supposed PJ conviction that Madeleine died as a result of accident caused by Kate McCann.
I will just add another note - before I let it rest until we actually know more about this (hopefully sometime soon)…
1. If this was indeed suggested to her at the interview that they knew that Madeleine died accidentally as a result of her actions and that she should confess now, I suspect that the PJ will have enough evidence confirming the death of Madeleine in the room. I suspect that this evidence is possibly beyond reasonable doubt and admissible in court. The only possibility IMO is that this evidence is related to blood specks or fluids and NOT with death-scent by dogs (which as we know is not admissible in Court).
So Madeleine is dead and died in the room. So what?
2. I am very inclined to suggest that the known circumstances of her death indicate someone’s actions and not an accident whilst alone in the apartment. If there was any prospect of Madeleine falling down or hurting herself this would have been the obvious route to pursue with a view to charges being pressed.
So, Madeleine died in the apartment accidentally. But if the police thought that she died alone as a result of an accident whilst the parents were out they would have been charged with crime of abandonment / neglect leading to death. This would have happened in September (when they were made arguidos). But it didn’t happen and they were allowed to return with minimum restrictive measures (TIR). § let’s put aside the role that the British diplomatic muscle may have played or not.
3. I suspect that the PJ will have sufficient evidence to support that Madeleine died in the apartment, as a result of someone’s actions (and not alone), but is yet to determine exactly who is responsible for the actions that lead to Madeleine’s death. The two prime suspects are likely to be the parents (although others cannot be excluded a priori). Until they determine whose actions caused death, charges will not be pressed.
So what next: IMO there are very few possibilities to determine who should be charged. Either the police are able to determine time of death (with certain accuracy) and please remember there are still tests ongoing in B’Ham (as we heard last week), or the body is found (in a condition that enables forensics from determining time of death). Alternatively one of the two main suspects confesses to having performed the fatal action / or denounces the other suspect.
Lacking any prospects of a confession or denounce, the PJ is probably reliant on the accurate determination of time of death (by forensic scientists in B’Ham) to be matched with as accurate as possible timeline of who was where (hence new interviews in the UK last week and request for reconstruction).
All speculation of course.

Another problem was that the restaurant did not open until half an hour before the children’s 7pm bedtime. With no buggy, they were forced to carry the children home between the two of them on their previous visit.
The McCanns and the seven friends they were on holiday with say they had a system of half-hourly checks on their sleeping children while they dined at the tapas restaurant in the resort each night.
“I think if there’d been one second where someone had said ‘Do you think it’s going to be OK?’ it wouldn’t have happened,” Kate McCann tells the cameras.
Her husband adds: “We have to live with the fact that we weren’t directly there and if we were, then, you know, possibly, probably, it wouldn’t have happened.”
