As Leslie Felperin, the excellent reviewer for Variety magazine remarked to me: the newspaper-reading public can’t be persuaded to react in the same way: they care about Madeleine McCann in a serious mood, or in a non-serious mood, they care about Sir Alan Sugar or Simon Cowell. The idea of actually caring about a violent arthouse film investigating the life of Bobby Sands is a very tall order indeed.

Yes; the content may be undisclosable but where the phones were at particular times would be physical evidence, certainly in this country.
You were away when I posted about Raphael & Anor, R v [2008] EWCA Crim 1014 (13 May 2008) which has some interesting stuff about mobiles, blood, DNA and partial matches in a murder trial in this country.
‘The jury was in possession of a very detailed schedule of every relevant telephone call, and the judge identified some of the specific calls in the context both of Horgan’s movements, and the varying accounts of his movements given by Johnson during the course of his police interviews. Both were relevant, Horgan’s movements because they were challenged by Johnson, and Johnson’s movements because the Crown asserted that the interviews represented the deliberate fabrication of an alibi, subsequently abandoned.’
And then there’s the blood and DNA:
‘Mr Sutton had the advantage of his own DNA expert to address the issue of the 1mm blood stain found on the welt of one of Johnson’s trainers. Part of the DNA contribution matched that of the deceased. It was approximately 80,000 times more likely that it was from him rather than from someone related to him. That meant, of course, that on a statistical analysis a number of individuals living within the London area might have provided the blood stain.
A number of possible theories were advanced to explain the blood stain, including innocent contamination by Emma Horgan on the evening in question.
We have been asked to consider whether the decision in R v Hoey, and the procedures now deemed appropriate, requires further examination of this area of evidence. We have examined the Crown Prosecution checklist for Low Copy Number DNA analysis. We can find nothing to suggest that there was any failure to follow the newly formulated procedures designed to protect the interests of the defendant. There is nothing in this point.’
The appeals against conviction were dismissed…

if you scroll down to the fourth picture, you can see a similar view as that of the sun’s picture. you can see first of all that the sun’s picture was not taken from the balcony but more taken closer to the wall surrounding the pool, and secondly that the pool is more to the right of the picture and the tapas bar can be seen, just. but it is a fair distance, much further than the picture in the sun suggests.

My Russian is non-existent; I did know someone who was a Russian specialist who lived down your end of the country.
It made playing Risk with him particularly over the top; he used to hold out till the last member of the 13th Yakutz Tractor Regiment was lowered reverently into the bosom of Mother Russia.

Sam… they don’t get shackled in UK prisons. Best we do is handcuffs going to and from court etc. and cuff them to the beds if they’re in hospital.
US have shackles… are you not in UK?
US jail is far harder than here.

I was just signing off and saw your post. the reason the Judge refused permission for
the phone evidence is to do with Human Rights and Privacy. I think the same principle
would be used in a U.K. Court.
However, as I read it, a submission was made to just use numbers which would show
who was calling who and where they were at the time. I do remember the triangulation
bit where say, it could be proved that GM was talking to one of the Tapas 7 from the
Barn, supposedly where the towel was found. Anyway, we”ll soon find out.

179-I’ve bored you all with this story before, but I’m pretty sure that when we were robbed in Fuerteventura-it was the swimming pool cleaner who watched me leave via the front of the appartment at 6am with the baby every other morning-and…I left the patio doors unlocked-My partner was still sleeping in appartment….when i got back all valuables were missing.
I know this proves nothing but he was best placed to know movements of all guests.

‘Yes, I”m sure they have all “conspired”, same as the meeting in the Hotel when they knew they were to be interviewed.
The one thing for all of them now, if they don”t go the public will wonder why and

I mentioned this before and got ridiculed for it, all the male posters I stress!!!! I was
on a flight to Rome last Christmas and got chatting to the woman sitting next to me.
Turned out she too is a Cardiologist and knows Gerry, had met him a few times at
Seminars. Apparently he is well thought of in his ability and very friendly and
helpful. No way did she think he was guilty and said she too would have left Portugal in a hurry if she was innocent and in a strange Country.’

We knew about the 24 Hrs report but not the Morais translation. There might be
some truth in it but 24 Horas is not the most reliable Paper I gather.
One thing I cant quite understand, it may be the translation , the mobile phone calls
made (voices I gather) are not permissable as evidence but the numbers are being
considered. As I remember, U.K. experts were helping the Police in Portugal trace
the area the calls were made from, so is this what is meant?
