IRVINE WELSH arrives at the Irish Film Institute in Dublin carrying a holdall in two-tone, light beige leather; it gives the impression that he has just walked in from a picnic. Natural atrium light swamps his head and in a flash he’s almost on top of me, swapping his bag from one set of fingers to another and shaking my hand. His face contorts: he is an hour and a bit late and he’s sorry.
A halo?
Welsh’s jacket is reversible yellow. His T-shirt, in French, says “What would you do if this was the end of the world?” Well? “I don’t know,” he says, apparently uninspired by the question he is advertising.
Well, he could plug his new book: Crime:
“It’s the most difficult thing to write about,” says Welsh. “Child sex abuse tests the limits of our liberalism to the full. You have the whole idea of whether rehabilitation is possible or even desirable.” He was about halfway through the first draft when the Madeleine McCann story broke and forced him to stop writing for two months. “I couldn’t look at the novel or at the newspapers,” he says. “I thought I was never going to finish the book.”

‘Everybody sympathises with the parents of a disabled child, but there are limits to that sympathy when parental conduct ceases to bear any relation to the child’s welfare.’
That was the Lord Justice Wall in the Court of Appeal in the Charlotte Wyatt case; it will be interesting to see whether the same principle applies to the parents of a missing child…

Is it likely that Justice Hogg can judge that parents who are suspects in their daughter’s disappearance should have access to police information in advance of any legal clarification of their status (but not from Clarence M) ? Is it likely that Justice Hogg can judge that two police forces and the secrecy of justice should be overridden and give sensitive confidential documents to a dubious private detective agency - without it having any bearing on the course of justice? I can’t why Justice Hogg would rule in the parent’s favour (without clarification of their legal status) and then would this not be bad MCpublicity? Something must be missing here?
BTW I see that Coco’s posts early today confirm no leaks from Leicestershire police to the public/ journos

I’m sure you are right; there is a great deal missing here. If you look at those judgements authorised by the Family Court to be made public you will see that they are almost always prefaced by this statement:
‘The judgment is being distributed on the strict understanding that in any report no person other than the advocates (and other persons identified by name in the judgment itself) may be identified by name or location and that in particular the anonymity of the children and the adult members of their family must be strictly preserved.”
The anonymity of the children is dependent on the anonymity of the parents, and since the entire point is to protect the children as far as it is possible it seems extraordinary that the McCanns’ lawyers have allowed Clarence to make statements to the Press.
The lawyers, at least, should understand that the Family Court itself is, in most circumstances, the only person with the authority to disclose the very fact that there is to be a hearing relating to a named child.
So Heaven knows what they are playing at; it seems to me to be patently obvious that such a claim would be litigated as far as it can go, since it has very wide potential application. After all, all cases are heard on the specific facts of the case, but precedent is precedent…
It should, however, be amusing to see what our Courts would make of the claim that they have the right to authorise private individuals to pursue matters untrammelled by judicial requirements in every country around the world. After all, sightings in this country seem to be rather thin on the ground.
Police forces do not follow procedures because they feel like it; they do so either because they consider that it is more efficient or because they are required to do so by law.
Asserting that all of this can be dispensed with is a remarkable claim…

I think that his removal from the case may have been useful — not sure to whom — but may have
been useful at least in one way: we were sure that, as long as he was in charge, there would be a strong commitment to the investigation.

I think Clarence said this but as you point out it is not within his powers or knowledge to say that the hearing will be public.
