Before the Mail’s columnist can voice an opinion – and what is the case of Madeleine McCann but one of opinion upon opinion – time to go over the fact that has been established in 14 months of reporting (a child is missing) and hear the McCann plead their innocence.
Oh, there is one other fact: the “McCanns are “both 40”. Remember that.
PEARSON: “The Maddie detectives must now apologise”
Now it seems the spectacularly incompetent Inspector Cluesnos are ready to admit they have no evidence against the McCanns
Yeah, those hapless amateurs. If only the Portuguese wooden tops were more like the British tabloid hacks who root their maybes in Portuguese press reports and hunches. What of Robert Murat?
Now, thank heavens, the ordeal of the inquiry is nearing an end. Nothing can make up for the loss of Madeleine, but at least the family can continue their lives without the poisonous cloud of suspicion hanging over them. It’s the least they deserve.
Yes, an apology will remove any doubt. Bring in the PIs. It’ll be over by Christmas. Case closed.

Says the McCanns’ spokesman Clarence Mitchell, who may have a job for life:
If the case closes, who will hunt for Madeleine? And if Kate and Gerry’s arguido suspect status isn’t removed they will live under a cloud of suspicion. That is both immoral and inhumane… There are people in Portugal who have been arguidos for decades

Says a source: “If the case is shut without charges being brought, they cannot be arguidos, suspects, any more”.
Tell that to Clarence Mitchell (see above).
What of the facts?
Gerry McCann, a heart specialist, is “39”. Gerry is also 39 in the Sun.

You can guarantee that nothing pertaining to children will be discussed in open court.
As to whether there will be a transcript - family court is a law unto themselves - they do issue transcripts, unlike the COP, but anonymised, and at the courts discretion. If there is one it will be on Baailii, on line.
As to whether the McCann’s can object, of course they can object, they can take all their clothes off and jump up and down, there is no limit to what they can do - however I suspect what you are really asking is how far will it get them - and the answer to that is, within the letter of the law, exactly as far as the Judge wishes them to get…….
That is, after all, the function of a judge - they decide. Not the McCann’s.

thanks for that (not that I understood it all)
But if it is almost unheard of to hear a case in Open Court in the family courts then I can only assume it could relate to just about anything ( except the twins).
So it could be exactly what clarrie has been spinning, or an application to remove Madeleines WOC status, or an application to give the McC’s or their solicitors access to the part of the fund that is deemed to be Madeleines, orsomething completely different that non of us have predicted.
Can the public get access to the transcripts from an open court session?
If so where would they be found? How soon would they be available?
Could team McC could go along on Monday and object to it being held in open court?

I was thinking more of no abductor-just woke up and disorienated ended up on the beach and in the sea. I was on hols recently and a 2 yeaold boy went missing from a restaurant on a big complex-nobody thought of an abductor-just checked all the pools . He was found 15 minutes later having walked across a bridge, through a live show, a restaurant-up a flightof stairs to. reception and noone had noticed.I think he would have got further but the autmatic sensors on the door didn’t sense him and open.

I do remember an Irish family who were travelling back that night and said that they had seen a man carrying a child near the beach.
The times did not match JT/ team mcc’s timeline if i remember rightly.
I can’t recall him saying that the man was G McC though. He did however say that he did not think it was Murat (having met Murat in the bar a few times)
Personally think the blue bag was used earlier in the day.
If the nanny’s statements are true the twins were NOT in the appartment when the alarm was raised, but were returned to their room before the police arrived.

Yes it all seems to be about the wellbeing of a child overriding the wishes/interests of the parents in the case of conflict:
“Children of Jehovah’s Witnesses below the age of 16 years may
cause particular difficulty. The wellbeing of the child is
overriding and, if the parents refuse to give permission for blood
transfusion, it may be necessary to apply for a ‘Specific Issue
Order’ via the High Court in order legally to administer the blood

taken, that two doctors of consultant status should make an
unambiguous clear and signed entry in the clinical record that
blood transfusion is essential, or likely to become so, to save life

opportunity to be properly represented and are kept fully
informed of the practitioners’ intention to apply for the order.”
