Madeleine McCann: Reporting Injunction
MADDIE WATCH - Anorak’s at-a-glance guide to press coverage of Madeleine McCann
WHISPERS of an injunction:
That the UK press gets much of its insider information on the McCann case from reading “source says” in the Portuguese press is beyond doubt.
Can the UK press be barred from reporting on these reports?
Scott QC is listed leading for McCann today.
Abdullah Masry v Mona Al Khatib, High Court Family Division, Sumner J (led by Timothy Scott QC) – successful application for an injunction restraining the press generally from publishing stories about the parties and their children (contra mundum order) – application of the court’s jurisdiction in wardship;
As Anorak’s Carmen writes:
If there is an order made which prohibits the British media from reporting on items in the foreign press under the guise of harming Madeleine’s interests, then every tom dick and harry will be trying to repost it on Anorak under ‘freedom of speech banner’ - they may live on the dole in a council flat and be prepared for the contempt of court proceedings, but do you?
Updates to follow…

Why don’t you leave our Gandy and his absolute conviction to consider his own version of history and join the rest of us on the other thread.

No Chenny it was you and Ian who pushed conspiracy, along with many others.
As I said, her comments are at total odds with the Portuguese take.

That is a lie, Gandolf.
Just because the Attorney General came down like a ton of bricks on the McCanns there is no reason for you to have a fit of sulks.
And whilst I am usually tolerant of the give and take of debate I do not propose to tolerate you lying about my posts on this blog.
Nor should you have a hissy fit just because the Judge refused to repeat Scott’s opening claim that Madeleine had been abducted.
The Police won, the McCanns lost, and Madeleine’s interests were and are the ones which matter, insofar as they do not prejudice the public interest…

Yes, and that was good to hear.
I’m being somewhat economical with what I say until the full judgement is published, since I would not wish to inadvertently drop Anorak in it…

“There is, of course, one person who knows what has happened to Madeleine and where she may be found,” the judge said.
“I ponder about that person - whether that person has a heart and might understand what it must be like for Madeleine to have been taken and secreted from her parents and siblings and those she loved and felt secure with.
One person not two not seven not nine, how does one person concoct a conspiracy.
As I said Chenny simply at variance with the Portuguese take.

Tosh.
It was the McCanns who claimed a conspiracy, and carried on claiming a conspiracy right up until the trip to Strasbourg when they flip-flopped and started talking about a single criminal.
I assume that was because it finally dawned on them that they could not get anyone who knows anything about organised crime to believe in the dastardly gang kidnapping a little blonde girl for some filthy rich Arab pervert…

‘Just as she was careful to say that the McCanns had acted reasonably and responsibly in the Family Court Proceedings.’
You mean that she was careful NOT to say the above??
All that excitement
did you take any piccy’s???
Did you estimate the cost of this mornings public relations stunt?
any clues who’s funding it????
————————————-
No; she did say it. I’m merely pointing out that she said it in the context of the Family Court proceedings, not any period prior to that, irrespective of what Clarrie might wish to spin.
No, I didn’t take any piccies.
Vast sums of money.
I would imagine that the Constabulary and the Attorney General paid for their own lawyers, and the McCanns paid for theirs.
But at least the trustees of the Fund, placing their ‘Madeleine’s best interests hat’ upon their heads, can heave a sigh of relief that they don’t have to pay for someone to go through the 11,000 pieces of paper in the files…

Mr and Mrs McCann were not present at the hearing in London. Mrs Justice Hogg said she had not asked for their attendance because “they have suffered enough and I wished to ease their burden”.
What a wonderful thoughtful woman, perhaps justice is not dead after all.

“The judge has made a statement calling on the abductor to show mercy and compassion. To come forward. She hopes and prays for madeleine!”

Tosh.
She was incredibly careful not to say that there was an abductor; Judges usually are careful in the language they use, not least because they don’t like getting overturned on appeal.
Just as she was careful to say that the McCanns had acted reasonably and responsibly in the Family Court Proceedings.
Clarrie may spin that as ‘reasonable and responsible’ throughout, but that’s just spin…

Such heart warming comments by a truly wise woman…aka Justice Hogg
Mr and Mrs McCann were not present at the hearing in London. Mrs Justice Hogg said she had not asked for their attendance because “they have suffered enough and I wished to ease their burden”.
The judge urged anyone with information about the missing girl to come forward.
“There is, of course, one person who knows what has happened to Madeleine and where she may be found,” the judge said.
“I ponder about that person - whether that person has a heart and might understand what it must be like for Madeleine to have been taken and secreted from her parents and siblings and those she loved and felt secure with.
“I ponder whether that person has a conscience or any feeling of guilt or remorse or even cares about the hurt that has been caused to an innocent little girl, and whether that person has a faith or belief and what explanation or justification they might give to God.
“I entreat that person, whoever they may be, to show mercy and compassion and come forward now and tell us where Madeleine is to be found.
“I hope she will be found soon, alive and well.”

Bollox.
The McCanns had just been made forcefully aware that, however nicely judges in the Family Court behave, they don’t allow sentiment to interfere with the orders they give.
If she had done anything other than throw it out it would have been appealed all the way to the Lords; the Chief Constable made a small concession so that ‘all shall have prizes’, but that was it.
Presumably some unkind person might also query what was the point of having a Wardship order made if nobody knew about it; how can people assist the Court if they don’t know that the Court wants their assistance?

Gandolf - I’ve read them. I’m not amazed at all by any power?
She said that someone has information and should come forward if they have a heart and say where Madeline is to be found.
Sounds to me like justice Hogg was inadvertantly telling the mccanns for god sake just let it up. Tell us what you did.

Well, other than the ignomy of exiting the High Court with Brunty, there aren’t many beans to spill, since the judgement will be published.
What the McCanns tried to do was argue that the High Courts Wardship order which says anyone with any information about a missing child should tell the Court bound the Police Forces, and Soci and Uncle Tom Cobbley and all, to tell the Court all, for onward transmission to the McCanns private detectives.
