A BRITISH mum whose daughter was taken into care on holiday faces up to ten years in jail.
It’s “cash-strapped Stephanie Bysh”.
What do we know about here?
She a brunette. And, as reported, she and one Ariella D’Gamo were “sleeping on the streets before a friend took them in. The worried pal took the eight-year-old girl to cops in Lagos, Portugal. She is now staying at a children’s home.”
How does Madeleine McCann fit in?
Bysh fled the resort — near where Madeleine McCann disappeared in May 2007 — but collapsed with kidney problems in Portimao 15 miles away.
That close, eh. Yesterday the incident was 25 miles from where our Maddie went missing. Such are the facts.

You mean Rose Ron’s grandfather who told police that he had killed the 4-year-old?
What more of their Maddie?
At its heart lies the bizarre love triangle in which little Rose’s grandfather fell in love with his son’s young bride and fathered two more daughters with her. Police say the grandfather has admitted killing the child and dumping her in a river, but no body has been found and there is no forensic evidence proving her death.
Just like our Maddie, then? It’s uncanny.

Fiona Payne’s statement was taken on the 4th of May 2007, at 7.30 by an inspector belonging the 4th brigade of the DIC
The interviewee is heard as a witness, belonging to the group who came to Portugal with the child Madeleine. Fiona P. is married to David who came on the same trip. She has known the child’s parents for about 7 years. She met Kate while they were both working together, and she already was a friend when she met her future husband David. The McCann couple has 3 children, a pair of twins aged 2, and Madeleine, who is almost 4. The witness has 2 children, one who is one and the other 2 years old. Her husband, who already came to Portugal 11 years ago, gave them the idea of coming there.
They arrived on the 28th of April of this year, around 12.00, coming from Leicestsh. to Faro, and finally Praia Da Luz. From Faro to the OCEAN CLUB, they travelled in a minivan from the airport. Once they had checked in, they were given appartment G5H for the whole family (husband, mother, two children).
As regards their pattern of habits, the witness says that in the morning, after breakfast which the family had at the club’s bar around 08.15/08.30, they put the children in one of the creches of the complex, each one in a different section. In the afternoon, the children took a nap while she and her husband stayed in the appartent. The nap ended around 15.30/16.00 when they all went together to the swimming pool or to the tennis, where the witness stayed until18h00/19h00 with her husband and children. After that, they went back to the appartment, washed the children, put them to bed, and met the rest of the group, for a dinner between grown-ups, at the Tapas Restaurant, which is situated near the Club.
During no dinner did the witness or her husband go to their appartment to check that the children were OK, because they would have heard any slight noise or crying thanks to their interphone (”Baby Monitoring” type). Yesterday, they slightly modified their habits. Thus, she went to the beach with the children, her husband, and her mother Dianne. They arrived there at 3.45 and came back around 6.15 PM. to go to the tennis where they stayed until 7.00 . The witness then went to her appartement with her children and her mother. In the appartement, her mother gave a bath to the children with the help of her husband, while she was jogging on the beach until 8.00. After that she went to her appartent, did a little bit of housecleaning, and around 8.45, she, her mother, and her husband went to the restaurant “Tapas” where they were meeting the rest of the group. Among which, at dinner, the couple McCann was.
The witness states that Kate and Gerry, went to the club to see if the children were all right, several times and regularly. So did other couples. As she was doing one of those checkings, Kate came back, very scared and nervous, even in a state of panick, and announced that Madeleine had disappeared.
Immediately, groups were organised to search for her, either in the appartment, as she could have hidden herself there, or outside, but to no avail, even though the staff were helping. Later, given Kate’s state of anxiety, she decided to stay with her and help.
The witness never entered Madeleine’ family’s appartment.
Knowing Madeleine well, the witness describes her as very smart, and quite unable to go with an unknown person without shrieking or protesting vigourously, unless she were very tired, or asleep.
About what Jane said, she only told them she had seen a person with a child in his arms but she didn’t know if the child was Madeleine.
The witness didn’t notice anythig abnormal during the holidays. She has no other information to supply.
After reading the report, with the help of the interpreter who explains what it says, she agrees to it, and signs it.

] there’s this one very interesting sentence, if I translate it correctly:
“En ce qui concerne les propos de Jane, cette dernière a seulement dit avoir vu une personne avec un enfant dans ses bras mais qu’elle ne savait pas si il s’agissait de Madeleine.”
“Inasmuch as Jane’s words are concerned, the latter has only said to have seen a person with a child in his arms, but that she didn’t know if it was Madeleine”

Yes, it seems the police asked how the group travelled from Faro on 28 April (answer, by minibus) but didn’t ask when the declarant last saw Maddy, (more relevant IMO given that Maddy wasn’t abducted from the minibus)

A few remarks before Fiona Elaine Payne’ statement (the rest will come in my next post)
Before we publish Fiona’s statement, we think it interesting to answer a few quetions we received by e-mail. We received many, but will try to answer a few. It has to be understood I wasn’t there when the statements were made. Nothing in the report explains how some of the questions were put, or what those questions were, apart here and there, where it says : “following our question, the witness says….. “. In a usual audition like those (let us not forget the case is of a child disappearing) the pattern is often the same. The investigators probably asked a few open questions, which might have been such as : (It is only surmising on my part, but based on a long experience which makes it likely that I am not mistaken).
How long have you been in Portugal Portugal ?
How long have you known the parents of the child ?
How did your stay go ?
How did the 3rd of may go daytime ?
How did the 3rd of May go evening time ?
How did the parents treat their children, and specially Madeleine?
Did you notice anything out of the ordinary ?
What is Madeleine like (her personnality) ?
Was she sick ? Did she take any medicine
It is logical to think that pattern was the one the PJ used to ak questions. This technique of asking open question is the only worthwhile one in an audition.Let me give you an example of a closed question: “Was the suspect’s car green?”Such a closed question isn’t admissible in an audition, as it influences the witness. An open question like “What colour was the suspect’s car?” is suitable, as it doesn’t influence the witness at all.

stevet, ive always wondered why there’s no snack meal mentioned after the high tea meal, maybe it’s just me but i find it an extraordinary long time for little tots to go without food, from 5.30 or six, to the next morning when the shops open and you can buy rolls and the like. but in the reports there’s no mention of another later supper and i find that odd.

Well we know that these two physically fit/athletic parents couldn’t be a*sed to walk their kids down to the Millenium so they could breakfast with the rest of the group….they didn’t seem to have much trouble ‘jogging’ themselves here, there and everywhere tho’ .

Sorry I have to disagree. From Day One this case was dogged by rumour, speculation and multiple different versions of the truth - this continued in the media and on blogs for over a year. To see what people actually were saying to the police on Day Two is in my opinion very illuminating (as is dispelling disinformation about for example Mr Murat, the aerobics instructress, grainy cctv footage, etc etc etc.)
Will the case ever be solved? Well, to me that is largely a matter for the journos now, perhaps if the Portuguese ones build up a head of steam the UK ones will follow.
There is always an achilles heel.

cc, from what i’ve read there were quite a few serious lapses made. but the child is still missing and would not have been had the parents been there when they should have been, and that’s only with the assumption they had nothing to do with her disappearance.
