Antonio de Pascale And His ‘Lolita’ Make Waves In Italy
IN Italy a 34-year-old Italian man has had sex with a 13-year-old girl.
Antonio de Pascale, a butcher from Vicenza, had a four-month long relationship with the unnamed girl.
In court, de Pascale’s lawyers put forward the notion of a “deep tenderness” between their client and the girl, with whom he had “fallen head over heels in love”.
The lawyers say the girl had wilfully taken part in the affair. Lolita?
De Pascale could be sentenced to 12 years in jail. But the court in Vicenza hears the lawyers words, and they strike a chord. De Pascale is sentenced to just one year and four months in jail.
A sentence of less than three years means de Pascale is unlikely to serve any jail time.
Antonio Marziale, the president of the Association for the Protection of the Rights of Minors, says: “It is not right to judge whether or not a 13-year-old girl is willing. The law should safeguard young girls who are too immature to make these decisions against adults without scruples.”
Simonetta Matone, a judge in Rome, said the law must “always look to be reasonable in these cases… Every relationship is a relationship and the real maturity, whether physical or psychological, of the minor must be weighed, with the help of experts.”
De Pascale broke the law. But did he get away with it too lightly? Who is right?

Two separate issues here: the girl is way too young for any commitment with anyone. Not only a sexual relationship, but possibly a maternal one too,and it is NOT for her to have the experience or knowledge of her feelings at that young age. She is a young girl, and must be allowed to enjoy that state without the responsibility of adult relationships
He should never have let things develop between them, and the courts seriously need to address why he can only cope with a child as a sexual partner.
Whether he harmed her or not is not a point here, he could have and he may have emotionally,and only time will tell

This is a hard one!
A 13 yr old girl is quite capable of infatuation, even some element of sexual maturity, and hormones raging all over the place. Plus I have no problem with the idea of that a 34 yr old man could fall in love with a 13yr old.
But if I was to put myself in the 34yr old’s shoes, I would hold off in the knowledge that her emotional maturity was very questionable so I would adhere to the law and wait til she was 16.
Surely, if you wanted to take the ‘romantic’ view, he could have waited patiently and allowed her the space to grow into an emotionally more mature age.
Having said that, I didn’t mature emotionally until I reached my 30s - actually, probably later.
Plus it’s not a great example to set is it. Unfortunately in order for laws to work there has to more black and white and less grey otherwise I can just see every seducer of 13yr old’s using the same tactic.

A mate of mine once commented that when you’re 15 , you fancy 15 year old girls, and it’s not a problem.
When you’re 35 , you still fancy 15 year old girls, but it’s just not seen as acceptable any more

What if he was 44, or 54, or 64 ???
The Law needs to draw a line in the sand! Black and white, this is the line and you DO NOT cross it!!!!
Some people need help to keep their emotions under control because they haven’t been born or haven’t had the upbringing to have that ability themselves.
In the Uk the Black and White line is the girls 16th Birthday and this is spot on in my opinion, if antonio had waited 2/3 years the law would not be involved in making decisions for him!!!

I object to age being used as a factor to determine suitability of a relationship. If the guy treated the girl well and mutually consented, then there is nothing wrong here. It would be different if he raped the girl or if the girl was a little kid. But since she is a physically mature teenager, I see nothing wrong with it.

Age of consent in Italy is 14, they could have waited.
Age of consent in Burkina Faso & Nigeria & Spain & South Korea is 13, he should have gone on holiday.
