Probably won’t read this but I’ve looked at the cases you refer to, and others.
I think the difference with this case would lie in the definition of “substantial” with regard to the period of the time the children were left alone. This looks to be no more than 30 minutes at a time, probably often less if the timeline on the night in question, as reported (???!!!) is to be believed. That is NOT like leaving kids for THREE hours!! The children were said to be fast asleep unlike the little boy strapped into the car who was also left for a substantial period of time.
This case was analysed by another lawyer in the Times very early on. The only thing which was thought to indicate possible neglect was the unlocked patio windows. (It appears from what the Mark Warner staff said that many tenants did not double lock those windows.) This seems to have been for ease of access by anyone checking the children from the group of friends. I still believe (could be wrong, it would depend on who was hearing the case) that this would not be seen as neglect. They were too near (80 paces, 50 yards), the apartment was partially visible from the terrace of the tapas bar where they were sitting on the other side of the pool, the children were asleep and the checks were frequent and regular. They have no history of neglect and are generally seen as responsible people.
All these factors make in unlikely, in my personal view, that a prosecution would stick, particularly as it could safely be assumed that they have learnt their lesson over leaving children. Obviously I can’t be certain. These legal matters depend on the interpretation of the wording of regulations.
In any case, it still seems a pointless exercise. Nobody else will be deterred by any charges being brought if they haven’t already been deterred by the disappearance of the child, however rare an event a kidnapping might be. People’s behaviour has already been affected by this case. Ask anyone who has holidayed since then in a similar sort of site. A lot more young kids are in the restaurants, it seems. Admittedly I base this on anecdotes from friends who tell me that the waiters say behaviour has changed and their own observations of the numbers of young children around who would in the past have been already in bed, and also on an interesting article in the Times a few weeks ago. The writer suggested that many British holiday makers felt their holidays were now ruined because they could no longer do what they had always done before, ie pop down to the bar or restaurant once their kids were “safely” tucked up in bed or sit having a drink by the pool while their children slept.
I do NOT condone what happened but I still think it quite likely that nothing would come of any attempt at prosecution. It would be small change to the McCanns anyway. They’ve already been punished for what they did infinitely beyond anything any court might impose. I also think that for that very reason, any court would be pretty disgusted by any attempts at prosecution.

REPLY: Not applicable, I’m afraid. The Press Complaints Commission only deals with cases where you or your organisation has been misrepresented by factual errors or distortion - read the Press Complaints Code on the Press Complaints Commission website on the Net.
P.S. Away now on the Lee Balkwell Inquest (see Wikipedia entry) from 4 to 12 October - 7 full days - but will visit Anorak during the evenings when I can. We learnt just 2 days ago that the chief ’suspect’ in the case, David Bromley, has been extradited to Germany to face an armed robbery charge, thus neatly preventing him from attending the Inquest.
An application by fax yesterday to adjourn the Inquest until he can be produced has been refusd by Coroner Caroline Beasley-Murray (same Cororer who mishandled the Stuart Lubbock Inquest). The father of the dead man Mr Les Balkwell had learnt on the grapevine about Bromley’s probable extradition as long ago as 18 August, and David Bromley actually went to Germany on 19 September. So why wasn’t he and his legal team told until late Tuesday this week that Bromley had been extradited?
Barrister Tony Venthan will re-apply for an adjournment this morning, or failing that will ask for a video link from a German jail so that he can give evidence to the Inquest. It promises to be a livley first day!
The Bromley family claim Lee was mangled to death in a concrete mixer at 1.00am on 18 July 2002 at their farm near Upminster; the Inquest has been delayed for over 5 years. The father has evidence that his son was done to death by members of the Bromley family an hour or so beforehand and the concrete mixer was a cover. There are very credible claims of a cover-up by Essex Police at a high level. Two of the Bromleys are in jail for serial drug-dealing and firearms offences, and are known police informers.
Is this case, like that of Madeleine McCann and Stuart Lubbock, another
’smokescreen’ case to cover a violent attack?
