It’s weekend and Gerry has suggested that no further developements are expected until Madeleine will be found. Maybe this finally gives us the time for some sideline discussion. I suggest to discuss today about whether 3 little children should be left alone during their parents’ dinner, taking into consideration that this might make the parents guilty of neglect or not.

Nothing has changed 6 month later. I don’t think she is still alive. I do hope of course for the sake of this little girl she is. She is the victim of neclect. Dead or a live. If alive, she’ll be psychology so scarred and will never be the happy girl she used to be. She would be haunted by newspaper journalists for the rest of her life. Whatever the outcome will be it is a very sad story in which Madeleine plays the main role of a big Drama. I don’t feel their will be a happy end to this. Living happily ever after? I don’t think so.

REPLY: Ferdinand, about three or four weeks ago, I mentioned here that a group of us plan to issue a private summons against both McCanns for neglect of a child - under Children and Young Persons Act 1933. A poster here called Andy, who I don’t think has contributed to Anorak for the past 3 weeks or so, gave us all a list of decided cases on child neglect (i.e. case precedents) which showed that leaving three young children on their own all evening - as the McCanns did - is prima facie likely to constitute the offence of child neglect. If we receive confirmation from Leicestershire Police and Social Services that no prosecution of the McCanns is planned in relation to their child neglect, we intend to proceed shortly with an application to Leicestershire Magistrates Court

In R v Jasmin, L (2004) 1CR, App.R (s) 3, the Appellants had left their child aged 16 months old alone in the home for periods of up to 3 hours, whilst they went off to work. This happened on approximately three separate occasions. The Appellants were both found guilty of offences relating to neglect contrary to S1(1) Childrens’ and Young Persons Act 1933 and were sentenced to concurrent terms of 2 years imprisonment.

In M v Normand (1995) SLT 1284, HCt Judiciary [ a Scottish case which may have persuasive authority ],the Appellant had parked his car leaving his son aged 18 months old strapped in a child’s car seat in the rear of the car whilst he and his wife went to do some Xmas shopping. A traffic warden was on duty when he saw the Appellants’ car with the chid in the car seat. The child was sitting quietly, appeared to be awake, not distressed and adequately clothed. The police were called and remained next to the car until the parents returned some 55 minutes later. The Appellant was found guilty of a contravention of s12 Childrens & Young Persons (Scotland) Act 1937in that he did “wilfully neglect and abandon him in a manner likely to cause him unnecessary suffering and injury to health”.
It was submitted that “where a child of this age was left on its own for a substantial period, VERY LITTLE MORE WAS REQUIRED IN ORDER TO ESTABLISH THAT THE OFFENCE HAD BEEN COMMITTED… and that “the child might have become distressed simply by reason of it being left alone in that period of time, and this was a circumstance which could cause unnecessary suffering or injury to health…”

International law states that “The exercise of parental responsibility is governed by the law of the State of the child’s habitual residence. If the child’s habitual residence changes, it is governed by the law of the State of the new habitual residence.” So it would appear the UK law is applicable.

Back in September, Gerry McCann issued this statement:

The privately hired detectives will continue to earn their keep for the next six months by constantly providing ’sightings’ of Madeleine supposedly being transferred by taxi to some remote Moroccan mountain. Perhaps they can keep this thought alive until the time for the McCanns to be regarded as ‘arguidos’ has expired. Clarence will hope it keeps the focus off evidence from cadaver dogs and the DNA and provide sufficient doubt to cloud the issue. With Gerry back at work, life resumes as normal and interested parties will be bored into a state of lethargy…

Im not sure she was that happy before, we dont know. This family dont seem to have the number of pictures most people nowadays have of their children, especially at the end of a six day holiday. Some of the pictures they use are of her when she was even younger, kids change so much in short time periods.
Maybe they didnt see much of her? Perhaps it should be creches and nannies who would have mor pictures and more collective knowledge of this child?

Interesting legal system you have, hard to understand for a European from the continent. I understand that you can issue a private summons while not having any personally interest in the case (i. e. you are not a victim of the McCanns)?

Might be that she just never bonded with this little girl.
It might be that its difficult to discuss her - as s he knows everyhting she says is based on a lie, even if its not a lie in itself.

Interesting that her new quote says that 6 months is a long time for Madeleine to be separated from her family. Her old quote, which I criticized in here, was that 6 months is a long time for HER to be without Madeleine. They also provided a new photograph! I think Stevo and others were correct: TEAM MCCANN reads this and other forums carefully and attempts to improve their story. I was glad to help them out, but they should know I do not work for free. I will be sending them my bill… naturally whatever I am paid will be forwarded to the ANORAK FUND TO HAVE THE MCCANNS FOUND.

In their case understandable though. They were too busy playing tennis, jogging, taking kids to and from nurseries. Eating tapas without them, sending loads of text messages and so on. So it is understandable isn´t it=

It’s a strange thought that any stranger can sue me for an alleged offense that did not cause any harm, financially or physically or whatever, to him. To make it clear, he can of course make a report to the police or the prosecutor, that’s something different. Then it’s up to the prosecutor to file a charge or not.
